Clifton Park man who allegedly “menaced” NYS Police Officer indicted by Saratoga Grand Jury for violent felony
Saratoga County District Attorney James A. Murphy III announced today the indictment by a Grand Jury of Douglas D. Stewart, III(9-28-69) of 7 Cardinal Court, Clifton Park, NY for the crimes of:
One Count of Menacing a Police Officer in violation of Section 120.18 of the Penal Law, a Class D violent felony. The defendant faces up to 7 years in prison on this count.
Two Counts of Criminal Possession of a Weapon in the 4th Degree, in violation of Section 265.01 (1) of the Penal Law, as a Class A Misdemeanor relating to two handguns he allegedly possessed for which he did not have a NYS pistol permit. The defendant faces up to one year in jail on each of these two counts.
One Count of Criminal Possession of a Weapon in the 4th Degree, in violation of Section 256.01 (2) of the Penal Law, as a Class A Misdemeanor relating to the rifle he allegedly possessed with intent to use it against another. The defendant faces up to one year in jail on this count. All of the sentences described above, would by law run concurrently.
The indictment stems from an incident in Clifton Park at the defendant’s home where on August 6th, 2013 the defendant intentionally placed a police officer in reasonable fear of physical injury or serious physical injury or death by displaying a rifle, which was operable, where the officer was performing his official duty and the defendant had reason to know he was a police officer.
The defendant was initially arraigned in Clifton Park Town Court, bail was set at $25,000 cash, $50,000 bond, the defendant posted the bond on August 19, 2013 and was released to Saratoga Hospital for further treatment. The defendant was required to surrender his passport as part of his bail release.
Saratoga County Court Judge Jerry J. Scarano received the Hand Up by the Grand Jury Foreman today and the matter has been scheduled for an arraignment on Monday, September 23, 2013 at 1:15 pm.
