Saratoga County District Attorney Karen A. Heggen announced today that the Saratoga County Grand Jury handed up this morning an Indictment to Saratoga County Court Judge James A. Murphy, III involving Nikolai Mavashev, 19, (DOB: 12/15/97), of 25 Hidden Farm Lane, Halfmoon, NY and Joseph Broscko, Jr., 17, (DOB 8/16/00) of 9 Linden Court, Clifton Park, NY.  The Indictment alleges that both Mavashev and Broscko committed the following offenses:  Murder in the Second Degree, New York State Penal Law (“PL”) 125.25(1); Robbery in the First Degree, PL 160.15(2); Robbery in the First Degree, PL 160.15(4); Robbery in the First Degree, PL 160.15(1); Assault in the First Degree, PL 120.10(1); Criminal Use of a Firearm in the First Degree, PL 265.09(1)(a); Criminal Use of a Firearm 1st, PL 265.09(1)(b); Criminal Possession of a Weapon in the Second Degree, PL 265.03(1)(b); Aggravated Criminal Possession of a Weapon, PL 265.19; Criminal Possession of Stolen Property in the Fifth Degree, PL 165.40 and Petit Larceny, PL 155.25. 

Additionally, Nikolai Mavashev is charged individually with Murder in the First Degree, PL 125.27(1)(a)(vii); Manufacture, Transport, Disposition and Defacement of Weapons and Dangerous Instruments and Appliances, PL 265.10(6); Unlawfully Growing Cannabis, PHL 3382 and Unlawful Possession of Marijuana, PL 221.05.  Joseph Broscko is charged individually with Murder in the Second Degree, PL 125.25(3).

The indictment alleges the defendants shot and killed an acquaintance, David Feliciano, during a robbery in Mechanicville, New York on August 7, 2017.  Both defendants were apprehended and charged two days later, on August 9, 2017.  District Attorney Heggen noted, “The arrest of the defendants was the result of the collaborative efforts of the Mechanicville Police Department and multiple units of the New York State Police.  The Indictment handed up this morning to Saratoga County Court Judge James A. Murphy, III, reflects the thorough and complete investigation of these various law enforcement agencies”                 

District Attorney Heggen has declined to comment further on the facts of the case at this time due the continuing nature of the investigation.  The arraignment for Mavashev is scheduled in Saratoga County Court for Friday, September 22, 2017 at 1:30 pm.  The arraignment for Broscko is scheduled in Saratoga County Court for Friday, September 22, 2017 at 1:00 pm.
